§1 Applicability to Businesses and Definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version in effect at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial activities nor to their self-employed professional activities (Section 13 of the German Civil Code (BGB)).

§2 Formation of a Contract, Storage of the Contract Text

(1) The following provisions regarding the conclusion of contracts apply to orders placed through our online store at https://www.happylounge.camp.

(2) If a contract is concluded, the contract takes effect upon

concluded.

(3) The presentation of goods in our online store does not constitute a legally binding offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase contract.

Acceptance of the offer must be made in writing or in text form, or by shipping the ordered goods within one week. If this deadline expires without action, the offer is deemed rejected.

(4) Upon receipt of an order in our online store, the following rules apply: The consumer submits a binding offer to enter into a contract by successfully completing the ordering process provided in our online store.

The ordering process consists of the following steps:

Before submitting a binding order, the consumer can use the “Back” button in the webto return to the webpage where the customer’s information is entered, correct any input errors, or cancel the ordering process by closing the web browser. We will immediately confirm receipt of the order via an automatically generated email (order confirmation). This does not yet constitute acceptance of the offer. Acceptance of the offer will be made in writing, in text form, or by shipping the ordered goods within one week.

(5) Storage of the contract text for orders placed through our online store: We store the contract text and send you the order details and our Terms and Conditions via email. You can also view the Terms and Conditions at any time at https://happylounge.camp/agb/. You can view your past orders in our customer area under My Account –> Orders.

§3 Prices, Shipping Costs, Payment, Due Date

(1) The prices listed include sales tax and other price components. Any shipping costs are added separately.

(2) The consumer may choose to pay in advance or via PayPal.

(3) If the consumer has chosen to pay in advance, he or she agrees to pay the purchase price immediately after the contract is concluded.

§4 Delivery

(1) Unless we have clearly stated otherwise in the product description, all items we offer are ready to ship immediately. Delivery will take place within 7 business days at the latest. The delivery period begins the day after the payment order is sent to the bank handling the transfer for payments made in advance, and the day after the contract is concluded for all other payment methods. If the end of the period falls on a Saturday, Sunday, or public holiday at the delivery location, the period ends on the next business day.

(2) Even in the case of a sale by mail order, the risk of accidental loss or accidental deterioration of the sold item passes to the buyer only upon delivery of the item to the buyer.

§5 Retention of Title

We reserve ownership of the goods until the purchase price has been paid in full.

You have the right to cancel this contract within fourteen days without giving any reason. The right of cancellation does not apply to goods that are custom-made according to customer specifications or are clearly tailored to your personal needs.

The cancellation period is fourteen days, starting from the day on which you or a third party designated by you—other than the carrier—took possession of the goods.

To exercise your right of withdrawal, you must notify us

by means of a clear statement (e.g., a letter sent by mail, fax, or email) regarding your decision to withdraw from this contract. You may use the attached sample withdrawal form for this purpose, although its use is not required.

Consequences of Withdrawal

If you withdraw from this contract, we must refund to you all payments we have received from you, including delivery costs (except for any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option we offer), without delay and no later than fourteen days from the day on which we receive notice of your withdrawal from this contract. We will use the same payment method for this refund that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees in connection with this refund.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever comes first.

You must return or hand over the goods to us immediately, and in any case no later than fourteen days from the date on which you notify us of your withdrawal from this contract. The deadline is met if you ship the goods before the fourteen-day period expires.

You are responsible for the direct costs of returning the goods.
